While bankruptcy is always the last option, sometimes it is the only one. However, bankruptcy does not have to be the end of life as you know it. In fact, it can be a new start for you and your family.

Because of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, there are new procedures that must be followed. Bankruptcy laws require that in order to file a bankruptcy petition, you (and your spouse if both are filing) must receive a certificate of credit counseling (Pre-Bankruptcy Financial Counseling Certificate). The purpose for this is to ensure that there is no other way to repay the debt.

Additionally, before a judge can sign off on the petition for bankruptcy, a second certificate is required (Financial Education Certificate)**. This certificate is obtained by attending a two hour personal financial management class. During the class, you will learn how to avoid predatory lenders, how to budget your money, how to rebuild your credit after a bankruptcy and how to use credit wisely.

Consumer Credit Counseling Services of Northern Nevada is approved to issue certificates in compliance with the Bankruptcy Code.  Approval does not endorse or assure the quality of an agency's services.

If you are having trouble making your home loan payments and are considering bankruptcy, it is highly recommended that you visit the government's HAMP (Home Affordable Modification Program) website,
MakingHomeAffordable.gov.

The Making Home Affordable Program is a critical part of the government's effort to stabilize the housing market and help struggling homeowners get relief and avoid foreclosure.  The Program includes opportunities for homeowners in bankruptcy to modify their mortgage to make their payments more affordable through the Home Affordable Modification Program.
